This Acceptable Use Policy ("AUP") outlines prohibited uses of CallChimp's services. By using our platform, you agree to comply with this policy. Violations may result in immediate suspension or termination of your account.
⚠️ Important Notice: You are solely responsible for ensuring your use of CallChimp complies with all applicable federal, state, and local laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and state telemarketing regulations.
1. Legal Compliance Requirements
1.1 Telephone Consumer Protection Act (TCPA)
You must comply with all TCPA requirements, including:
- Prior Express Consent: Obtain proper consent before making automated or pre-recorded calls to mobile phones or residential lines
- Do-Not-Call Compliance: Honor the National Do-Not-Call Registry and your internal do-not-call list
- Time Restrictions: Make calls only between 8:00 AM and 9:00 PM in the recipient's local time zone
- Caller ID: Display accurate caller identification information
- Opt-Out Mechanism: Provide clear opt-out instructions and honor opt-out requests immediately
- Record Keeping: Maintain records of consent and opt-out requests
1.2 Call Recording Consent
You must comply with federal and state call recording laws:
- Determine if you are in a one-party or two-party consent jurisdiction
- Obtain required consent before recording calls
- Provide clear notification that calls are being recorded
- Include recording disclosure in your AI scripts or recorded messages
1.3 State and Local Laws
Many states have additional telemarketing and robocall regulations. You are responsible for researching and complying with laws in all jurisdictions where you make calls.
2. Prohibited Activities
2.1 Illegal or Fraudulent Activities
You may NOT use CallChimp to:
- Engage in any illegal activity or promote illegal products or services
- Commit fraud, identity theft, or financial crimes
- Impersonate any person, entity, or government agency
- Make false, misleading, or deceptive statements
- Engage in phishing, scamming, or social engineering attacks
- Violate securities laws or regulations
2.2 Harassment and Abuse
You may NOT use CallChimp to:
- Harass, threaten, or intimidate any person
- Make repeated unwanted calls to the same number
- Use profane, abusive, or offensive language
- Engage in stalking or threatening behavior
- Bully or discriminate against individuals or groups
2.3 Restricted Content and Industries
The following types of campaigns are prohibited or restricted:
- Prohibited:
- Adult or explicit content
- Illegal substances or controlled substances
- Weapons, explosives, or dangerous materials
- Stolen goods or counterfeit products
- Ponzi schemes, pyramid schemes, or multi-level marketing without disclosure
- Cryptocurrency scams or unregistered securities
- Restricted (Requires Compliance Documentation):
- Debt collection (must comply with FDCPA)
- Financial services (must comply with CFPB regulations)
- Healthcare-related services (must comply with HIPAA)
- Student loan services
- Insurance sales
- Political campaigns (must comply with election laws)
2.4 Spam and Unsolicited Communications
You may NOT:
- Call numbers on the National Do-Not-Call Registry without proper exemption
- Call individuals who have requested not to be contacted
- Make calls without obtaining required prior express consent
- Use purchased or scraped lists without verifying consent
- Engage in high-volume spam calling practices
2.5 Technical Abuse
You may NOT:
- Attempt to gain unauthorized access to our systems
- Reverse engineer, decompile, or disassemble our software
- Use automated tools to scrape or harvest data from our platform
- Overload or interfere with our servers or infrastructure
- Circumvent usage limits or access controls
- Introduce malware, viruses, or malicious code
- Share your account credentials with unauthorized parties
2.6 Intellectual Property Violations
You may NOT:
- Use copyrighted materials without authorization
- Infringe on trademarks or service marks
- Violate publicity or privacy rights
- Use our branding or marks without permission
3. Data and Privacy Requirements
3.1 Lead List Quality
You must ensure that:
- You have the legal right to contact all numbers in your lead lists
- Your data was obtained legally and ethically
- You maintain accurate records of consent
- Your lists are regularly updated and scrubbed against do-not-call registries
3.2 Data Protection
You must:
- Comply with GDPR, CCPA, and other data protection laws
- Protect personal information in your lead lists
- Not share or sell contact data inappropriately
- Honor data subject rights (access, deletion, etc.)
4. AI Content and Messaging Standards
4.1 Truthful and Accurate
All AI conversations and recorded messages must:
- Be truthful and not misleading
- Accurately represent your business and offers
- Include required disclosures and disclaimers
- Not make false claims or guarantees
4.2 Proper Identification
Your calls must:
- Clearly identify your business name
- Provide a call-back number
- Disclose the purpose of the call
- Inform recipients if calls are recorded
4.3 Respect and Professionalism
Your AI scripts and messages must:
- Be professional and respectful
- Not use aggressive or high-pressure tactics
- Respect cultural and social sensitivities
- Provide clear opt-out instructions
5. Campaign Monitoring and Compliance
5.1 Your Responsibility
You are responsible for:
- Monitoring your campaigns for compliance
- Reviewing AI conversation quality and accuracy
- Responding to complaints promptly
- Making necessary adjustments to maintain compliance
- Keeping accurate records of your campaigns
5.2 CallChimp's Rights
We reserve the right to:
- Monitor campaigns for compliance with this AUP
- Suspend campaigns that violate this policy
- Request documentation of consent and compliance
- Terminate accounts engaged in prohibited activities
- Report illegal activities to authorities
6. Enforcement
6.1 Violations
If you violate this AUP, we may:
- Issue a warning and require corrective action
- Suspend specific campaigns or features
- Suspend or terminate your account
- Refuse to provide future services
- Take legal action to enforce our rights
- Report violations to regulatory authorities
6.2 No Liability
CallChimp is not liable for your violations of this AUP or applicable laws. You agree to indemnify CallChimp for any claims arising from your use of the Service.
